1 Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and AppAspect Technologies Pvt. Ltd. (“AppAspect”, “we”, “us”) governing your use of the Xpensplit mobile application and any related services (collectively, the “Service”).

By downloading, installing, or using Xpensplit, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2 Eligibility

• You must be at least 13 years of age (or 16 in the EEA where applicable) to use Xpensplit.
• If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• You must have the legal capacity to enter into a binding agreement in your jurisdiction.
• You may not use the Service if you are prohibited from doing so under applicable law.

3 Account Registration

3.1 Account Creation

To access most features, you must create an account using a valid email address or via Google or Apple Sign-In. You agree to provide accurate and complete information and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at apps@appaspecttechnologies.com if you suspect unauthorised access.

3.3 One Account Per Person

Each person may maintain only one Xpensplit account. Creating multiple accounts to circumvent restrictions or abuse free-tier benefits is prohibited.

4 Description of Service

Xpensplit is a personal expense tracking and bill-splitting application. It allows users to:

• Create groups and track shared expenses among friends, family, flatmates, or colleagues.
• Record, categorise, and split expenses by various methods (equal, percentage, exact amounts).
• Scan receipts using on-device AI/OCR to pre-fill expense details.
• View simplified debt settlement suggestions to minimise the number of transactions.
• Record settlements and track group balances in real time.

5 Free Tier & Subscriptions

5.1 Free Tier

Xpensplit is available for free with core features including unlimited expense entry, group creation, guest profiles, basic receipt scanning, and basic spending charts. The free tier includes non-intrusive advertisements served by Google AdMob.

5.2 Xpensplit Pro Subscription

Pro features are available via in-app subscription (monthly, yearly, or lifetime) managed through the Apple App Store or Google Play Store. Subscriptions are subject to the respective store’s terms and refund policies.

5.3 Billing & Renewal

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your App Store or Google Play account settings.
• We do not process payments directly; all billing is handled by Apple or Google.

5.4 Refunds

All purchases are processed by Apple (App Store) or Google (Play Store). Refund requests must be directed to the respective platform per their refund policies. AppAspect Technologies does not issue refunds directly.

5.5 Price Changes

We reserve the right to change subscription pricing. We will provide reasonable advance notice of any pricing changes. Continued use after the effective date of a price change constitutes acceptance.

5.6 Feature Changes

We may modify, add, or remove features from any tier at any time. We will endeavour to provide advance notice for material changes that affect paying subscribers.

6 Acceptable Use

You agree to use Xpensplit only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any fraudulent, deceptive, or illegal purpose.
• Attempt to gain unauthorised access to other users’ data, groups, or accounts.
• Reverse engineer, decompile, or disassemble the application.
• Use automated tools (bots, scrapers) to access or interact with the Service.
• Interfere with or disrupt the integrity, performance, or security of the Service or its infrastructure.
• Upload malicious code, viruses, or any software designed to damage or disrupt the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service to transmit unsolicited communications (spam).
• Create accounts using false identities or for the purpose of manipulating the Service.
• Violate any applicable local, national, or international law or regulation.

7 User Content

7.1 Your Content

You retain ownership of all content you submit to Xpensplit, including expense descriptions, amounts, notes, and receipt images (“User Content”).

7.2 Licence to AppAspect

By submitting User Content, you grant AppAspect a non-exclusive, worldwide, royalty-free, sublicensable licence to store, reproduce, and process your User Content solely for the purpose of operating and improving the Service. We do not use your financial data for advertising targeting.

7.3 Content Responsibility

You are solely responsible for the accuracy of expense data you enter and the appropriateness of content you share within groups. Xpensplit does not verify the accuracy of user-entered financial information.

7.4 Content Shared with Groups

Any expense descriptions, amounts, notes, and receipt images you add to a group will be visible to all current members of that group. Please exercise judgment about what information you share in group contexts.

8 Guest Profiles

Xpensplit allows registered users to create “guest profiles” — placeholder entries for people who do not have a registered account. By creating a guest profile for another person, you represent that:

• You have the consent of that person to be included in the group expense tracking.
• You will only use their name (no sensitive personal information) for the purpose of tracking shared expenses.
• You will inform them that their name is being used in Xpensplit and provide them with a means to request its removal.

AppAspect is not responsible for guest profiles created without the knowledge or consent of the named individual. If you believe a guest profile has been created for you without your consent, contact us at apps@appaspecttechnologies.com.

9 Intellectual Property

9.1 Our IP

Xpensplit, including its name, logo, design, code, algorithms (including the debt simplification algorithm), graphics, and all related materials, is the exclusive property of AppAspect Technologies Pvt. Ltd. and is protected by copyright, trademark, and other intellectual property laws.

9.2 Licence to You

Subject to these Terms, AppAspect grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Xpensplit app on your personal devices for your personal, non-commercial use.

9.3 Restrictions

You may not copy, modify, distribute, sell, sublicense, or create derivative works of the Service or any part thereof.

9.4 Feedback

If you provide AppAspect with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable licence to use that feedback for any purpose without compensation to you.

10 Disclaimers

To the fullest extent permitted by applicable law, AppAspect disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, error-free, or free of viruses.
• Warranties regarding the accuracy, reliability, or completeness of any content.

Financial Disclaimer: Xpensplit is a personal expense tracking tool. Nothing in the Service constitutes financial, legal, or tax advice. You are solely responsible for the accuracy of data you enter and any financial decisions made based on the information displayed.

11 Limitation of Liability

To the maximum extent permitted by applicable law, AppAspect Technologies, its directors, employees, and partners shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or goodwill.
• Financial losses arising from inaccurate expense tracking or reliance on the app’s balance calculations.
• Damages arising from unauthorised access to or alteration of your data.
• Damages resulting from third-party services (Firebase, AdMob, Adapty, Open Exchange Rates).

Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising from your use of the Service shall not exceed the greater of: (a) the amount you paid for a subscription in the 12 months preceding the claim, or (b) USD $10.

12 Indemnification

You agree to indemnify, defend, and hold harmless AppAspect Technologies, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service in violation of these Terms.
• Your User Content or the content of guest profiles you create.
• Your violation of any applicable law or third-party rights.

13 Termination

13.1 Termination by You

You may delete your account at any time via Settings → Delete My Account. Deletion terminates this agreement with respect to your account. Subscription cancellation must be handled through your App Store or Google Play account settings.

13.2 Termination by Us

AppAspect may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. We will make reasonable efforts to notify you where legally permissible.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.

14 Governing Law & Disputes

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. For users in the EEA or UK, applicable EU/UK consumer protection laws continue to apply.

14.2 Dispute Resolution

We encourage you to contact us first at apps@appaspecttechnologies.com to resolve any dispute informally. We will make reasonable efforts to resolve disputes within 30 days.

14.3 Jurisdiction

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

14.4 Consumer Rights

Nothing in these Terms limits any rights you may have as a consumer under the laws of your country of residence. EEA users may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

15 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the “Effective Date” at the top of this page.
• Send a push notification or in-app alert for significant changes.
• For changes that materially affect your rights, we will seek fresh consent where required by law.

Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
